1. Eligibility
- You must be at least 18 years of age to create an account or transact on OurBazaar. The Platform handles legally binding contracts and payments, and we require all users to have full contractual capacity under Pakistani law.
- You must be a resident of Pakistan, or otherwise lawfully able to transact within Pakistan, unless we explicitly permit access in another jurisdiction.
- You must not be on a sanctions list maintained by Pakistan, the United Nations, or any other relevant authority, and you must not be barred from using the Platform under a prior suspension.
- By registering, you represent that all information you provide is accurate, current, and complete, and you agree to keep it up to date.
2. User Accounts
- Each natural person may hold one (1) personal account. A registered business may hold one additional store account. Creating duplicate accounts to bypass a ban or limit is prohibited.
- You are responsible for maintaining the confidentiality of your login credentials, including your password, OTP codes, and any OAuth provider linked to your account.
- You must verify your phone number via OTP before transacting. Certain features (selling, withdrawing, high-value bidding) additionally require successful KYC.
- You must notify us immediately at support@ourbazaar.pk if you suspect unauthorised access or any compromise of your credentials.
- You authorise us to act on instructions received from your account so long as our verification checks pass. You remain responsible for activity on your account until you notify us of a compromise.
- OurBazaar reserves the right to suspend, restrict, or permanently terminate accounts that violate these Terms, our community guidelines, or applicable law.
3. The Marketplace
OurBazaar is a peer-to-peer marketplace that connects buyers and sellers. We facilitate transactions; we are not a party to the sale agreement formed between users. Sellers are solely responsible for the accuracy, legality, and fulfilment of their listings, and buyers are responsible for inspecting listings before they purchase.
3.1 Permitted Items
- Pre-loved (second-hand) personal property: clothing, footwear, accessories, bags, jewellery, watches, eyewear, and similar items in legally tradeable condition
- New items listed by verified business sellers, subject to our store-onboarding approval
- Handmade and artisanal goods
- Authenticated luxury goods, where the seller can produce reasonable provenance / authenticity evidence on request
3.2 Prohibited Items
The following may not be listed or sold on OurBazaar under any circumstance:
- Counterfeit, replica, or otherwise IP-infringing goods (including unauthorised “1:1” copies)
- Firearms, ammunition, parts, or any item regulated under the Pakistan Arms Act and the Pakistan Customs Act
- Narcotics, psychotropic substances, or any item regulated under the Control of Narcotic Substances Act 1997
- Alcohol, tobacco, and vaping products
- Stolen or unlawfully obtained property of any kind
- Adult or sexually explicit content, obscene material, and items facilitating illegal activity
- Live animals, animal parts, and products derived from endangered species (CITES restrictions apply)
- Currency, lottery tickets, financial instruments, and securities
- Hazardous materials, fireworks, and items requiring special transport handling
- Items that violate any third party's intellectual property, publicity, or privacy rights
- Personal data (name lists, contact databases, account credentials)
- Anything else that violates Pakistani law, including but not limited to the Prevention of Electronic Crimes Act 2016
OurBazaar reserves the right to remove any listing and suspend any account at its sole discretion if a prohibited item is offered. Repeated violations lead to a permanent ban and may be reported to the Federal Investigation Agency's Cyber Crime Wing.
4. Seller Responsibilities
- Listings must be accurate, complete, and not misleading. Photographs must be of the actual item being sold (stock images are not permitted except for new business inventory).
- Sellers must clearly disclose the item's condition using the OurBazaar condition scale (new with tags, new without tags, gently used, used, vintage) and call out any flaws.
- Sellers must own the right to sell the item and confirm it is not stolen, counterfeit, or under any encumbrance.
- Sellers are responsible for packaging the item securely and handing it to the courier within the handling time stated in the listing.
- Sellers must honour every confirmed order. Repeated cancellations after order confirmation will trigger limits on listing volume and, after a documented pattern, suspension.
- Sellers must respond to buyer questions within a reasonable time. Response time is reflected on the seller's profile and feeds into search ranking.
- Sellers are responsible for all taxes arising from their sales, in accordance with the Federal Board of Revenue (FBR) and provincial revenue authorities. OurBazaar may furnish transaction summaries to comply with lawful tax-information requests.
- Sellers must not communicate with buyers in ways that bypass the Platform (asking for off-platform payment, soliciting personal contact information for purposes other than direct-pickup coordination, etc.).
5. Buyer Responsibilities
- Buyers must review listings carefully before purchasing. Questions about size, fit, authenticity, or condition should be raised in chat with the seller before the buy-now or bid action.
- Buyers must make payment in full at the time of placing an order through one of the Platform's supported payment methods.
- Bids on auction listings are binding (see Section 6). Buy-now purchases create an immediate sale contract subject to seller fulfilment.
- Buyers must inspect items promptly upon receipt and raise any issue through the in-app issue window described in Section 9.
- Buyers must not initiate fraudulent chargebacks or payment disputes with their bank or wallet provider without first attempting resolution through OurBazaar Support. Chargebacks raised without good-faith use of our dispute flow may result in account suspension.
- Buyers who choose Direct Pickup commit to the additional terms in Section 7.
6. Auctions & Bidding
- A bid placed on an auction listing is a binding offer to purchase at that price if it is the highest bid when the auction closes. You may not retract a bid except in narrowly defined cases (typo correction within the first minute, seller materially changed the listing) approved by Support.
- Sellers may set a Reserve Price. If the reserve is not met when the auction closes, no sale is completed and the listing returns to the seller.
- OurBazaar may apply a Buyer's Premium on top of the winning bid. The premium percentage is shown to the bidder at the time of bidding and again at checkout.
- A winning bidder must complete payment within the payment window stated on the auction (typically 48 hours from auction close). Failure to pay within the window allows the listing to be re-offered to the next-highest bidder or to be relisted.
- Shill bidding (bidding to inflate the price on your own item, including via accounts you control), bid retraction abuse, and any manipulation of auction outcomes are strictly prohibited and will result in immediate account termination.
- OurBazaar may cancel an auction or void specific bids where fraud, duress, or material listing inaccuracy is reasonably suspected.
7. Direct Pickup
Some listings offer Direct Pickup as a delivery option. When you choose this option:
- The seller's pickup city and suburb / landmark are shown to you on the order tracking screen after payment is confirmed.
- Exact address and pickup time are arranged between buyer and seller through in-app chat. Do not disclose pickup details, share addresses, or arrange meetups outside the chat.
- OurBazaar is not responsible for in-person safety. Meet in public, well-lit locations during daylight hours where possible. Bring a friend if you can. Do not carry large amounts of cash.
- Payment is still processed through the Platform; do not hand cash to the seller. Marking an order “received” in-app is the trigger that releases payment to the seller.
- The 24-hour issue window described in Section 9 starts when you mark the order as received in the app.
- Either party may cancel a direct-pickup arrangement up until the in-person handover, at which point the order becomes binding.
8. Fees & Payments
- Listing items on OurBazaar is free for individual users on the Free tier. Subscription plans (Silver, Gold, Platinum) offer enhanced features and improved fee structures.
- OurBazaar charges a Platform Fee on every completed transaction. The applicable rate is shown at the time of listing and again at checkout.
- A Processing Fee, set by our payment partner, applies to every transaction to cover gateway costs.
- For auctions, a Buyer's Premium (Section 6) is added to the winning bid before fees.
- Subscription fees are billed monthly in advance and shown in PKR including any applicable taxes.
- Payments are processed through our integrated payment gateways. Full card numbers and CVVs are never stored by OurBazaar; only tokens and the last four digits are retained for reference and refunds.
- Payouts to sellers are released after the 24-hour issue window closes (Section 9), or earlier if both parties confirm the order is resolved. Holds may apply if fraud signals are detected, with the seller notified of the reason.
- All amounts on the Platform are denominated in Pakistani Rupees (PKR) unless explicitly stated otherwise. International payment methods may incur additional foreign-transaction fees from your bank that OurBazaar cannot rebate.
- OurBazaar will issue refunds only to the original payment method, and only within 7–14 business days of the refund being authorised.
9. Returns, Disputes & Issue Window
9.1 24-hour Issue Window
Buyers have a 24-hour issue window starting from the moment an order is marked “delivered” (or received for direct-pickup orders) to raise an issue if the item is significantly not as described, damaged in transit, or counterfeit. After 24 hours of no issue being raised, the payment is released to the seller and the order is closed.
9.2 Eligible Reasons
- The item materially differs from the listing (size, colour, condition, brand)
- The item arrived damaged due to insufficient packaging
- The item is counterfeit or otherwise infringes intellectual property
- The wrong item was shipped
- No item was shipped
9.3 Process
- Step 1: contact the seller through in-app chat with photos and a short description of the issue
- Step 2: if you and the seller cannot agree within 24 hours, escalate to OurBazaar Support via the “Escalate to Support” CTA in the chat header
- Step 3: OurBazaar Support will mediate in good faith, request additional evidence as needed, and issue a binding decision (refund, partial refund, return, or dismissal). Decisions are typically issued within 5 business days.
9.4 Refunds
Approved refunds are credited to the original payment method within 7–14 business days. Where the seller is at fault, OurBazaar may also bill the seller for the platform fee, processing fee, and any return-shipping cost. Either party may escalate an unresolved dispute to the relevant Pakistani consumer-protection authority.
10. Subscriptions
- OurBazaar offers paid subscription plans (Silver, Gold, Platinum) that unlock additional features such as more active listings, lower transaction fees, video uploads, and priority support. The current feature matrix is available on the Subscription screen.
- Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. The renewal charge is debited from the payment method on file.
- You may cancel your subscription at any time from Profile → My Subscription → Cancel. Cancellation takes effect at the end of the current billing period; you retain the paid features until then.
- Refunds for unused subscription time are at our discretion and are generally not offered. Refund requests for billing errors (duplicate charges, incorrect plan) are honoured within 30 days of the charge.
- We may change subscription pricing or feature inclusions on at least 30 days' notice. Your next renewal after the notice acts as your acceptance; if you do not wish to accept, cancel before the renewal.
11. Prohibited Conduct
You agree not to:
- Harass, threaten, abuse, stalk, defame, or otherwise harm other users
- Post false, misleading, deceptive, or defamatory content (listings, reviews, comments, support tickets)
- Attempt to circumvent the Platform to transact directly and avoid fees (i.e., asking another user to pay you off-platform)
- Scrape, crawl, or systematically extract data from the Platform without our explicit written permission
- Reverse engineer, decompile, or attempt to derive the source code of the Platform
- Introduce malware, viruses, ransomware, or any code intended to disrupt the Platform or its users
- Impersonate another person, organisation, or OurBazaar staff member; use a deceptive identity in chat
- Buy, sell, or attempt to use stolen payment instruments or compromised accounts
- Use the Platform for money laundering, terrorist financing, or any other unlawful purpose under Pakistani or international law
- Bypass, disable, or interfere with security or technical features of the Platform (rate limits, idempotency keys, fraud checks)
- Use the Platform to send unsolicited bulk communications, spam, or chain messages
12. Automated Processing
We use automated systems for fraud detection, prohibited-content scans on listings, KYC document validation, search ranking, home-feed personalisation, and (when you opt in) AI-generated listing descriptions. These systems are described in detail in Section 6 of our Privacy Policy. None of them produce a legally binding decision against you without human review available on request. If an automated decision materially affects you (listing removed, account suspended, KYC rejected), you may request human review by emailing support@ourbazaar.pk within 30 days of the decision.
13. Intellectual Property
All content, branding, design, code, and technology on the Platform (excluding user-generated content) is owned by or licensed to OurBazaar and protected by applicable Pakistani and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Platform or its content without our express written permission.
By posting content on the Platform (listing photos, videos, descriptions, reviews, comments, chat messages), you grant OurBazaar a non-exclusive, royalty-free, worldwide, sub-licensable licence to use, host, store, reproduce, modify (e.g., resize images), and display that content solely for the purpose of operating, providing, and promoting the Platform. You confirm that you own or have the necessary rights to grant this licence.
If you believe content on the Platform infringes your IP rights, send a takedown request to support@ourbazaar.pk with a description of the work, evidence of ownership, and the URL or listing id of the infringing content. We will review and respond within 7 business days.
14. Limitation of Liability
To the maximum extent permitted by applicable law, OurBazaar and its officers, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, loss of data, loss of goodwill, or loss arising from transactions between users. Our total aggregate liability for any claim arising out of or related to these Terms or your use of the Platform shall not exceed the greater of (a) PKR 10,000 or (b) the total fees you paid to OurBazaar in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be lawfully limited, including liability for fraud, gross negligence, or wilful misconduct.
15. Indemnification
You agree to indemnify, defend, and hold harmless OurBazaar, its affiliates, and their respective officers, directors, employees, and contractors from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of: (a) your use of the Platform; (b) your listings or purchases; (c) your violation of these Terms or any law or regulation; (d) your infringement of any third party's intellectual property, publicity, or privacy rights; or (e) content you post on the Platform.
16. Termination & Account Deletion
16.1 Self-Service Deletion
You may close your account at any time from Profile → Settings → Delete Account. Deletion is processed within 7 days. Some data is retained beyond that point per the retention windows in our Privacy Policy (fraud-prevention, tax, and dispute evidence), but is no longer associated with an active profile and is purged once the retention period elapses.
16.2 Termination by OurBazaar
We may suspend or terminate your account immediately, with or without prior notice, if we reasonably believe you have violated these Terms, our community guidelines, or applicable law. Where prior notice is reasonable in the circumstances, we will provide it. You may appeal a termination within 30 days by emailing Support.
16.3 Survival
On termination, your right to use the Platform ceases. Provisions that by their nature survive termination — intellectual property rights, limitation of liability, indemnification, governing law, and dispute resolution — remain in effect.
17. Governing Law & Disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan. Both parties agree to attempt good-faith negotiation before initiating formal legal proceedings. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Pakistan.
For cybercrime-related issues (account takeover, fraud, harassment), you may also report the matter directly to the Federal Investigation Agency's Cyber Crime Wing. For payment-processing complaints, you may also contact the State Bank of Pakistan or the bank that issued your payment instrument.
18. Changes to These Terms
We may revise these Terms at any time. The “Last updated” date at the top of this page always reflects the current revision. We will notify you of material changes via in-app notification and email at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes your acceptance of the revised Terms. If you do not accept a change, your remedy is to stop using the Platform and, if you wish, delete your account.
